Retra will reasonably cooperate in any defense by you of a third-party claim at your request and expense. You will have sole responsibility to defend Retra against any claim, but you must receive Retra’s prior written consent regarding any related settlement. You hereby waive any right to trial by jury arising out of this Agreement and any related documents.

Statute of Limitation. RETRA VENTURES PRIVATE LTD and / or its lending partner ECL Finance Ltd shall access your Credit Information as your authorized representative and RETRA VENTURES PRIVATE LTD shall use the Credit Information for limited End Use Purpose consisting of and in relation to the services proposed to be availed by you from ECL Finance Ltd. We shall not aggregate, retain, store, copy, reproduce, republish, upload, post, transmit, sell or rent the Credit Information to any other person and the same cannot be copied or reproduced other than as agreed herein and in furtherance to CICRA. The Parties agree to protect and keep confidential the Credit Information both online and offline.

The Credit Information shared by you, or received on by us on your behalf shall be destroyed, purged, erased promptly within 1 (one) Business Day of upon the completion of the transaction/ End Use Purpose for which the Credit Information report was procured.

Governing Law and Jurisdiction:

The relationship between you and RETRA VENTURES PRIVATE LTD and / or its lending partner ECL Finance Ltd shall be governed by laws of India and all claims or disputes arising there from shall be subject to the exclusive jurisdiction of the courts of Mumbai.

Definitions:

Capitalised terms used herein but not defined above shall have the following meanings:
“Business Day” means a day (other than a public holiday) on which banks are open for general business in Mumbai.
“Credit Information Report” “means the credit information / scores/ aggregates / variables / inferences or reports which shall be generated by Experian;
“Credit Score” means the score which shall be mentioned on the Credit Information Report which shall be computed by Experian.
“CICRA” shall mean the Credit Information Companies (Regulation) Act, 2005 read with the Credit Information Companies Rules, 2006 and the Credit Information
Companies Regulations, 2006, and shall include any other rules and regulations prescribed thereunder.

While using our Platform, whether the app or the website, we will collect such information from you including but not limited to:

• Your name, address, date of birth, gender, contact information (including but not limited to your phone number information), billing information, marital status, PAN number, name of the bank where You have a primary account, bank statements, pay slips, information relating to income and expenses obtained through bank SMS scraping and through integration with our service provider, etc.;
• Your Aadhar Virtual ID Number or the Aadhar Number on behalf of the financial lending partners;
• Details regarding your employment, including, years of experience, details of income, name of the current employer, details of the office address, details regarding the years/months completed with the current employer;
• Credit related information that is collected from other sources like the credit bureau;
• Information about your transaction history like spend data, through our mobile application;
• Any other information that Retra Ventures is required to collect as per specific mandate from any financial lending partners or as a requirement under applicable law;
• You hereby provide explicit consent to Retra Ventures and / or any of its lending partners to pull Credit bureau record as part of the credit due diligence
• You herby consent to RETRA VENTURES PRIVATE LTD being appointed as your authorised representative to receive your Credit Information from Experian for the purpose of providing credit underwriting assistance to the potential Lenders and for the provision of best financial offers (“End Use Purpose”).
